
NASSAU, Bahamas (April 27, 2007) — Virgie Arthur’s appeal to block Larry Birkhead from leaving the Bahamas with Dannielynn has been turned down, Access Hollywood’s Tony Potts reports from inside the courtroom.
One judge called Arthur’s appeal “weak,” and ordered her to pay $3,000 in attorney’s fees for wasting the court’s time.
Moreover, Larry has now obtained Dannielynn’s birth certificate, which indicates the baby’s full name is now Dannielynn Hope Marshall Birkhead.
At one point he said, “I am perplexed why this matter is before us.”

Larry Birkhead is the father. He just announced to the world, “I told you so.” The DNA results were unveiled inside and it’s a DNA match for Birkhead and Dannielynn.

And now there were three: Virgie Arthur has arrived in court in the Bahamas to find out who the father of her granddaughter is, and court proceedings are underway. Arthur, as TMZ reported, is likely to ask for custody of the baby, even if Larry Birkhead is the dad.
Though she wasn’t caught by TV cameras, Arthur, as is her custom, was the last of the three major parties in the Anna Nicole saga to arrive, and was wearing a white dress.

Howard K. Stern has arrived!!!
Howard K. Stern just arrived at the Bahamian courtroom where the father of Anna Nicole Smith’s baby is to be revealed shortly, remaining silent during his quick entrance into the building.
Stern got to the courtroom in Nassau just a few minutes after fellow baby-daddy-contender Larry Birkhead. There is no word on the whereabouts of Virgie Arthur just yet. Dozens of tourists are waiting outside in the sweltering heat with their cameras snapping away.
Everything is set to go within the courtroom. The world awaits.

Larry Birkhead arrived at court just moments ago in the Bahamas, with several members of his family in tow, and told reporters, “I hope to leave with one more.”
Alongside his brother, sister and their kids, Birkhead, wearing a gray suit, tie and sunglasses, said, “I’m a little tired, but I’m ready to get this over with.”
Howard K. Stern and Virgie Arthur have yet to arrive.
“If Larry Birkhead is confirmed to be Dannielynn’s biological father, Howard will not challenge custody. His love for her will not change, irrespective of the results. Howard will act in Dannielynn’s best interest, because he loves her and would want a smooth transition to protect her, as she is deeply bonded to those who have been with her since birth.
While Howard continues to believe and hope that he is Dannielynn’s biological father, he wants to be involved in her life, regardless of paternity. He wants to share the memories of her mother as the person who knew Anna best and all she wanted for Dannielynn.
Howard will do whatever is necessary to assist Larry Birkhead to defeat any effort by Virgie Arthur to obtain custody of Dannielynn.
Howard was not part of the paternity lawsuit filed while Anna Nicole was alive. The first person to challenge Howard on custody was Virgie Arthur — not Larry Birkhead. Howard is dedicated to Virgie Arthur not having custody of Dannielynn. He is well aware of how Anna Nicole felt about ‘Mommy Dearest’ and Anna’s feelings were clear regarding Virgie Arthur being anywhere near Dannielynn.
Speculation that this is somehow about money for Howard is misguided and wrong. Howard has never made a TV or book deal even though he is the one who knew Anna Nicole best.
Howard wants Anna Nicole to be remembered as an icon like Marilyn Monroe, and he knows a lot of damage has been done to her image in the past two months. This restoration of Anna’s image is important for Dannielynn and the views she will have of her mother as she grows up. He also wants to make sure that only Dannielynn profits from Anna Nicole’s name, likeness and estate. As TMZ reported earlier, the money from Anna Nicole’s funeral went to a trust set up for Dannielynn. Howard set up the trust but he does not, and will not, receive any money from it and is not the trustee.”
The Supreme Court was expected to hold a hearing Tuesday in the paternity case of Anna Nicole Smith’s infant daughter, but the lawyers and officials are prohibited by Bahamian legal rules from discussing the case, even to reveal the nature of the hearing.
The baby, Dannielynn Hope Marshall Stern, could inherit millions from the estate of Smith’s late husband, J. Howard Marshall II.
Smith, who collapsed and died Feb. 8 in Florida from an accidental overdose, had been fighting the Texas oil tycoon’s family over his estimated $500 million fortune since his death in 1995.
Howard K. Stern, Smith’s partner, dropped his bid Monday to halt the use of DNA to prove the paternity of the former Playboy Playmate’s daughter when it appeared a Bahamas court was going to reject his appeal.
An attorney for Stern withdrew the challenge in the face of skeptical questioning by a three-judge panel of the Court of Appeal.
All three judges said Stern filed his challenge too late and should have raised his objections before the Supreme Court ordered DNA testing in the paternity challenge filed by Larry Birkhead, a former boyfriend of Smith’s who claims to be Dannielynn’s father.
Justice Emmanuel E. Osadebay noted that Stern himself had agreed to DNA testing — and even suggested an expert to do the analysis — but waited until a week after the sample was taken to file the a challenge to the court’s decision.
“His problem is that the person he wanted to do the testing was not the one selected by the court,” Osadebay said.
In withdrawing the appeal, Stern agreed to pay $10,000 in legal costs incurred by Birkhead and the Bahamian government department in charge of birth certificates.
Stern is listed on the birth certificate as the father of Dannielynn, who was born in the Bahamas in September. The child’s DNA was tested March 21 but the results have not been revealed.

TMZ has learned Larry Birkhead got a Fed Ex on Saturday, and it was not good news. It was a bill for legal services from Debri Opri, the lawyer he fired two weeks ago. The total: $620,492.84.
Opri billed her services out at $475 an hour. Here are some of the charges:
- A total of three $1,500 monthly charges for Luck Media & Marketing, Opri’s personal publicist.
On March 1, 2007, the day before Anna’s funeral, there is a charge of 10 hours for “preparation for and attendance in Bahamas re services and var. meetings re same.” On the day of Anna’s funeral, there is another 10 hour charge with the exact same language. Ironically, TMZ knows Birkhead asked Opri not to even attend the funeral, but she did anyway. On March 3, Opri charged yet another 10 hours for travel from Nassau back to L.A.
- On February 24, 2007, while Opri and Birkhead stayed at a private residence in Ft. Lauderdale during the Florida hearing, Opri billed $600 for Seafood World. We’re told she brought four trays of lobster to the house. The bill says, “Dinner gift/Ft. Lauderdale house stay.” But it was no gift to Larry. That same day, she billed $211 for items at Publix grocery store.
- March 8, 2007, Opri billed $161.65 for an Outback Steakhouse dinner. And get this — the bill was for $111.65. Opri left a $50 tip and billed Birkhead, who wasn’t even there!
- Opri billed Birkhead $4,265 for Cingular roaming service while she was in the Bahamas.
- Opri billed Birkhead 18 times for Diva Limos that took them to and from the Ft. Lauderdale courthouse to the private residence.
- October 22, 2006, Opri billed Birkhead $1,116.16 for a dinner at Graycliff, a restaurant in Nassau. The note next to the charge is “Alexiou atty mtg.” Alexiou is Birkhead’s lawyer in the Bahamas. Birkhead was not present.
- The next day, October 23, Opri billed $2,467.75 at Graycliff restaurant for another meal. The charge again was for “Alexiou atty mtg.” Again, Birkhead was not present.
- Also on October 23, Birkhead was billed $25.75. The item — “laundry service Zawacki.” Zawacki is Opri’s husband, who was present on the trip. Ouch!
Opri’s bill reveals that “20/20″ is more than a TV show — it’s the number of hours she bills for a “20/20″ interview with Larry Birkhead. Opri and Birkhead went from L.A. to New York City on December 9, 2006, did the interview and returned the next day. Opri billed 10 hours travel time each way.
In all, the packet of bills Birkhead received today totaled 112 pages. Opri offered Birkhead a bargain: Instead of the $620,492.84 bill, she offered him a discount at $511,365.09, but only if he accepts immediately. Opri wrote, “I’m still willing to accept the discounted billing at this time, but only without further discussion.”

TMZ has learned Anna Nicole Smith will have her story told at the inquest in the death of her son, Daniel. We’re told one of the 40 scheduled witnesses on the witness list is not a person at all. The item reads: Anna Nicole Smith’s statement to police. The statement she gave following the death of her son could be a riveting moment.
Please let this be the end for her. I truly want her to RIP.

After performing an autopsy, it became clear, Anna Nicole Smith died of an accidental overdose of medication.
Dr. Joshua Perper, the Medical Examiner for Broward County, just announced the 39-year-old former Playboy playmate was taking a number of drugs, including methadone, anti-anxiety drugs and others.

According to Dr. Joshua Perper:
- ANS died as a result of accidental overdose
- No evidence of disease
- At the time of death, she was on methadone, anti-depressants, growth hormones, and weight loss pills
- She injected growth hormones, either ammuno-globulin or another longevity drug into her ass cheek before she came to the States
- She complained about the injection site on the flight to Fort Lauderdale, and in the limo from the airport, she had chills and was cold. When she arrived at the hotel she was spiking a fever. She was asked by HKS and others to go to the hospital and she firmly refused.
- At that time her shrink friend prescribed flu drugs, put her in an ice bath, and was given chlora hydrate
- She could not eat, only could have fluids. But by Wednesday, she was doing better.
- On Thursday, the day she died, ANS was awake, talked to HKS, he helped her to the bathroom, she was coherent but weak, then she came back and went to bed. That was the last he saw of her.
- ME confirmed there was no delay in talking her to the hospital, and she was not dead when paramedics arrived
- No abccess visible on the buttocks, but when sliced open, they found major scarring, abccesses and hemoraging from it. The high fever was due to the perforation of the abcess and the leaking of blood but there was no blood poisoning.
According to Chief of Seminole police Charlie Tiger:
- No evidence of illegal drugs
- No foul play
- Nothing unusual on security camera tapes from hotel
- Nothing on HKS’s or ANS’s laptop, but these were the new evidence delaying the autopsy
- Accidental overdose according to Charlie Tiger
- No criminal charges to be laid at this point
Hopefully now we can get Danni Lynn’s DNA results back this week and Anna Nicole can rest in peace…

According to Star magazine..Anna Nicole Smith died with a toxic level of the sleeping medication chloral hydrate in her system.
In a joint newsgathering operation, the National ENQUIRER and Star magazine have solved the mystery of the former Playboy model’s death and provide a detailed portrait of her final days.
The world exclusive details come days before Broward County, Fla., Chief Medical Examiner Joshua Perper will hold a press conference to announce the former Playboy Playmate’s cause of death.
The ENQUIRER and Star have also learned that Anna Nicole had a raging blood infection. The infection was caused by an unsterilized needle and contributed to her death.
The infection was so serious, it would have killed her if she had not overdosed.
Contrary to speculation, tests show Anna Nicole did not have methadone or any other painkilling drug in her system at the time of her death.
The ENQUIRER learned that just before she left the Bahamas for Florida on February 5, three days before she died, Anna Nicole received an injection in her left buttock.
Tests did not reveal what that substance was.
“As she boarded the plane for Miami, Anna Nicole developed a painful abscess at the site of the injection,” said a source with knowledge of the case. “The needle wasn’t sterile. The pain kept getting worse as the abscess got larger and larger very quickly.”
From Miami, Anna Nicole and her live-in lawyer Howard K. Stern traveled to Hollywood, Fla. The pain from the abscess became excruciating and Anna Nicole developed a high fever.
By the time she got to the Seminole Hard Rock Hotel & Casino her fever was 105.
Anna Nicole, unaware that her blood was being poisoned by infection, had also developed a second infection from a virulent form of norovirus, which causes intestinal problems.
It was at this point that Anna Nicole — and her entourage — made a fatal mistake. She refused to go to a hospital, a decision that would have saved her life.
Instead, Anna’s people gave her an ice bath to control the fever, administered the antibiotic ciprofloxacin by mouth and gave her an over-the-counter flu medicine.
As the needle-caused infection took over her body, she began vomiting, had severe diarrhea and could not urinate.
On February 6, a Tuesday, Anna spent the whole day in bed. She could not keep fluids down. She was becoming severely dehydrated.
On Wednesday, February 7, Anna seemed somewhat better, but she wasn’t, the source said.
“She was still vomiting and suffering diarrhea,” said the source. “Again, she spent the whole day in bed, as the abscess continued to grow. She was in such pain, she just wanted to sleep.”
And that’s when the final fatal mistake was made. Sometime overnight on February 7, Anna ingested the sleeping medication chloral hydrate. The drug is extremely potent. The dose was too much — and in fact it was a toxic level, the ENQUIRER and Star have learned exclusively. On Thursday, February 8, Anna never woke up.
A nurse found her unresponsive at about 1:30 p.m.
At 2:49 p.m., Anna Nicole Smith was pronounced dead.
Preliminary analysis indicated the cause of death was systemic sepsis syndrome, a lethal blood infection. It was caused by the abscess of the left buttock. Further investigation revealed the fatal level of chloral hydrate.
Chloral hydrate can cause depression of respiration, especially in a person who is already sick because of an infection and dehydration and it can cause death within a relatively short period of time.
Anna Nicole also had scarring from numerous injections she got in the buttocks.

Howard K. Stern might have to start spending Anna Nicole Smith’s money a lot sooner than he thought.
TMZ has learned that a corporation started by Anna Nicole Smith and handled by Howard K. Stern — owes more than $30,000 in back taxes and has been officially suspended by the Franchise Tax Board from doing business.
According to records from the California Secretary of State, Hot Smoochie Lips Inc. hasn’t filed a tax return with the State of California since its inception in 2002, and owes $28,945 in corporate taxes! Howard K. Stern is listed as the company’s “registered agent.” Anna was listed as the president. But that’s not all …
The Los Angeles County Tax Collecter claims that Hot Smoochie Lips Inc. never forked over $8,920.54 in property taxes they owe on a Studio City home where Anna used to live.
On March 1, 2007, Hot Smoochie Lips, Inc. was put into suspended status by the FTB, which means they can’t make any legal, financial or business transactions. It is unclear if any of Anna’s other belongings, including cars, boats and other property are actually registered to Hot Smoochie Lips, Inc.
Howard K. Stern was named as executor of Anna’s estate, which means that he may ultimately be the person responsible for cutting a check for all of Anna’s debts.

TMZ has learned the computer that has created renewed interest in the Anna Nicole Smith case contains e-mails from Smith to her doctors — e-mails about drugs.
We’re told the Bahamian police and Seminole cops met this week and discussed the contents of a computer that was in Anna Nicole’s room the day she died. Sources say the computer in question was Anna’s laptop, which she frequently used. The wife of Big Moe, Anna’s bodyguard, was on the computer as Anna was lying in the bed before 911 was called.
We know Anna sometimes communicated with her doctors in the United States via e-mail, even keeping copies of prescriptions and air bills for prescriptions in her computer files.
TMZ also knows that Dr. Joshua Perper, the Medical Examiner, has interviewed people about Anna’s drug use. We know Dr. Perper has asked about Anna’s use of injectible Demerol, and whether she swabbed alcohol on her skin before inserting the needle.
We’ve also learned that at least one cop from Nassau checked into the Hard Rock Hotel yesterday, the hotel where Anna died. Although we cannot confirm this, it appears that the computer may have linked two separate investigations — the Bahamian probe into the death of Anna’s son Daniel, and the Florida death of Anna.

Anna Nicole Smith’s former boyfriend Larry Birkhead claims he’s the father of Smith’s baby daughter, Dannielynn – and is so confident about it, he’s already getting his home ready for her.
“I’ve been putting a nursery together, so I’m smiling,” Birkhead said Tuesday after the latest hearing in Los Angeles in a paternity battle over the 6-month-old little girl. “I’m in a good mood.”
In a private session, a judge refused to grant Birkhead’s request that Smith’s companion at the time of her death, Howard K. Stern, take a paternity test. But Superior Court Judge Robert Schnider said he would review the matter and scheduled a follow-up hearing for March 27.
Birkhead’s lawyer, Debra Opri, said after the hearing, “Put up or shut up, that’s what we’re asking for.”
Smith died at age 39 on Feb. 8 of unknown causes and was finally buried on March 2 in the Bahamas.
A number of men have claimed paternity of Dannielynn, who stands to inherit potentially tens of millions of dollars from the estate of Smith’s late husband, Texas oil tycoon J. Howard Marshal II.
At a press conference Tuesday, attorneys in the paternity dispute between Birkhead and Stern confirmed that there had been private talks in the Bahamas, but Birkhead insisted: “My daughter is not for sale. The only discussions were over whether there will be a DNA test.”
He added that he was happy to have spent time with Dannielynn recently in the Bahamas, where the courts have ordered that she remain until various legal issues are resolved.
“It was one of the greatest things in my life,” he said. “It was magic.”
Stern, who is listed on the baby’s birth certificate as the father, argued that he didn’t have to take a paternity test.
“Howard K. Stern is the presumed father until one of the 12 or whatever people claiming to be Dannielynn’s father can come in and prove it,” said his attorney, James Neavitt.
Paternity may ultimately be decided by a court in the Bahamas, and the issue could be put on hold while the courts sort out Smith’s will, lawyers said.
“This is going to take months,” Neavitt said.
